Terms of Service

1. Service

Visitorly is a website analytics SaaS that combines the Visitorly Tracker with optional connections to Google Analytics 4, Google Search Console, Microsoft Clarity, team seats, reports, and AI digests. Access is granted through a paid plan (Whop or Stripe checkout when enabled) or an admin-approved request. Visitorly never stores full card numbers.

2. Accounts

• You must provide accurate registration and request information.
• You are responsible for safeguarding login credentials, authenticator codes if 2FA is on, and API keys you create.
• Do not share one password. Invite teammates and clients on Team with their own accounts.
• We may suspend accounts that abuse the service or violate these terms.

3. Plans, billing, and grace

Plans (Basic, Growth, Pro) define site limits, data retention, and features. When online checkout is enabled (Whop, Stripe, or both), paying activates the plan immediately. Otherwise you request access and an administrator approves after offline payment. Card subscriptions renew monthly until you turn auto-renewal off on Profile; access continues until the current period ends. Offline plans use a 30-day window and 7-day grace, then auto-suspend. Printable invoices are snapshots for your records. Visitorly never stores a full card number — only brand and last four digits from the processor. See the Refund Policy.

4. Acceptable use

You agree not to:

• Probe, overload, or reverse engineer the service except as allowed by law.
• Use Visitorly for unlawful surveillance or to violate others’ privacy rights.
• Share another customer’s public site key or attempt to access others’ data.
• Upload malware or use the tracker on domains you do not control or authorize.

5. Your content and sites

You retain rights to your websites and configuration. You grant Visitorly a limited license to process analytics events and integration data solely to provide the service. You represent that you have rights to install tracking on the domains you register, including any first-party CNAME you point at Visitorly.

6. Third-party services

Google, GitHub (when used for sign-in), Microsoft Clarity, OpenRouter, email/WhatsApp providers, Whop and Stripe (when used for checkout), and hosting providers are separate services with their own terms. Visitorly is not responsible for outages or policy changes of those providers.

7. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. Live status is published at /status. Features may change. Material changes to these terms will be reflected by updating the date on this page.

8. Disclaimers

Visitorly is provided “as is.” Analytics and AI insights are informational and may contain errors or delays. We disclaim warranties to the fullest extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, Visitorly and its operators are not liable for indirect, incidental, or consequential damages, or loss of profits/data arising from use of the service. Aggregate liability is limited to fees you paid for Visitorly in the three months before the claim (or zero if no fees were paid).

10. Termination

You may stop using Visitorly at any time, including deleting your account in Profile. The operator may suspend or terminate access for violations, non-payment, or operational necessity. Upon termination, access to dashboards ceases; retention of residual data follows the Privacy Policy.

11. Governing law

These terms are governed by the laws applicable to the Visitorly operator’s principal place of business, unless mandatory local consumer law says otherwise.
